There are many laws in place that are meant to stop domestic violence and to protect all those who may get hurt in the process. Not only are you going to have to deal with your local and state laws, but there are also many federal laws that are against domestic violence. The Violence Against Women Act that was brought into action in 1994 will criminalize any domestic violence instances that also occur with foreign travel or interstate. In addition, if you have been charged with these crimes, you are going to have to give up all your guns and other firearms for the time being.

These can be serious crimes to deal with and often those charged with domestic violence will be unsure of where to turn. Whether you have been in trouble with this kind of violence in the past or it was just an argument that got out of hand, make sure you have the right legal team in place to get this figured out quickly.

One thing to keep in mind is that the vawa is for anyone who is being harmed in their relationship. Even though it uses Women in the name, it does protect both males and females from this kind of harm.

Penalties

There are some stiff penalties in place for those who use domestic violence in order to harm someone or intimidate them to act in a certain way. Of course, each state is different and the particular penalties that you could face will vary depending on the court system and the unique situation that you are bringing in. Some of the penalties include one to five years in federal prison as well as a fine. The terms of prison will often vary depending on how hurt the individual may be.

If you receive this violation and it does not cause any serious injury to the body, a life threatening injury, permanent disfigurement, or death, you will receive a maximum of five years in jail. If the violation does include some serious injury to the body of the victim or if the violation had a dangerous weapon present, you could receive a maximum of ten years in prison. If the victim has an injury that is life threatening or they are permanently disfigured, you could face a maximum sentence of twenty years.

The worst one comes when the victim ends up dying because of the domestic violence. The courts are not going to look kindly upon this and you could spend the rest of your life in a federal prison if you are convicted. This is why it’s so important to find the right legal team to be on your side in these cases. It is never a good idea to go into the courts with these kinds of charges and rather, you should have a legal defense team to help you every step of the way.

If you are convicted of domestic violence in any state, you will also be penalized in terms of your firearms. You will not be able to transport, ship, or possess any ammunition or guns because of this misdemeanor. This is also true if you’ve been prohibited of being around someone else because of threats, stalking, or harassment of that other person.

Being charged with domestic violence is a messy process that could take a long time to sort out. Make sure to hire the right criminal defense lawyers to help you out so you can avoid trouble and get your life back on track as soon as possible. Don’t try to do it on your own; hire the professionals to make sure you get the help that you need.
